Under diversity jurisdiction, 28 U.S.C. § 1332, seeking application of Ohio law, Robert E. Wynn sued his employer Sears, Roebuck & Company for personal injuries. The district court granted Sears summary judgment based upon the fact that Wynn was injured by his fellow servant for whose negligence the employer is not liable. Wynn appeals from this aspect of the judgment. Although content with the result below, Sears contests the courts preliminary determination that it occupied a "dual capacity" relationship with Wynn, as his employer and as owner of the offending vehicle.
